CARIV LLC – Terms and Conditions

    Last Updated: 11/07/2025

These Terms and Conditions (“Terms”) govern the use and occupancy of properties owned and/or managed by CARIV LLC (“Company,” “we,” “us,” or “our”), as well as your use of our website, resident portal, and any related services (“Website/Portal”).

By applying for, leasing, renting, visiting, or occupying any property owned or managed by CARIV LLC (“Property”), or by using our Website/Portal, you agree to these Terms and to any lease, addendum, community rules, or policies that apply to your Property.

If there is any conflict between these Terms and your signed lease, the lease and any signed addenda shall govern for all tenancy matters.

    1. Eligibility & Application Process

1.1 Minimum Age. You must be at least 18 years old and legally capable of entering a binding contract to rent or occupy a property.

1.2 Screening. You authorize CARIV LLC to conduct background, credit, rental history, employment, and identity checks as permitted by Missouri law. Application fees are non-refundable unless required by law.

1.3 Fair Housing. CARIV LLC adheres to all federal, state, and local Fair Housing laws. We do not discriminate based on race, color, religion, sex, disability, familial status, national origin, or any other protected class.

    2. Lease, Deposits & Possession

2.1 Lease Agreement. All tenants must sign a written lease before occupying any property.

2.2 Security Deposit. A security deposit equal to one month’s rent (or as stated in the lease) must be paid in full prior to receiving keys or occupancy. Deposits are held in compliance with RSMo §535.300 and may be used for unpaid rent, damage beyond normal wear and tear, and cleaning costs.

2.3 Deposit Return. CARIV LLC will return the deposit, less lawful deductions, within 30 days of lease termination, provided the tenant supplies a valid forwarding address.

2.4 Possession. Tenants may not occupy or store items in the property until all move-in funds (including deposit and first month’s rent) have cleared.

    3. Rent & Fees

3.1 Due Date. Rent is due on the first (1st) day of each month unless otherwise stated in your lease.

3.2 Grace Period. CARIV LLC allows a 5-day grace period as a courtesy. Rent received after the 5th day of the month is considered late.

3.3 Late Fees. Late fees will accrue at $5 per day, not to exceed the maximum allowed by Missouri law (RSMo §408.140).

3.4 Returned Payments. Returned checks or ACH payments will incur a $35 NSF fee plus any bank charges.

3.5 Application of Payments. Unless prohibited by law, CARIV LLC may apply payments first to late fees, utilities, repairs, or other charges before applying to rent.

3.6 No Set-Off. Tenants may not withhold rent for any reason unless explicitly permitted by Missouri law or court order.

    4. Occupancy & Use

4.1 Authorized Occupants. Only the individuals listed on the lease are permitted to reside at the property. Guests may not stay more than 14 consecutive days or 30 days total in any six-month period without written consent.

4.2 Property Use. The property may only be used for lawful residential purposes.

4.3 Subletting. Subleasing or assignment is prohibited without prior written consent.

4.4 Prohibited Conduct. Illegal activity, harassment, disturbances, or conduct that interferes with other tenants or neighbors is strictly prohibited.

    5. Maintenance & Repairs

5.1 Tenant Responsibility. Tenants must maintain the property in a clean and sanitary condition and promptly report any maintenance or safety concerns.

5.2 Reporting. Maintenance requests should be submitted through the Website/Portal or by phone/email to CARIV LLC.

5.3 Negligent Damage. Tenants are responsible for any damage caused by misuse, negligence, or failure to report issues in a timely manner.

5.4 Right of Entry. CARIV LLC may enter the property with 24-hour notice for repairs, inspections, or showings, except in emergencies where immediate entry is permitted under Missouri law.

    6. Utilities & Services

6.1 Responsibility. Unless otherwise stated in the lease, tenants are responsible for all utilities (electric, water, gas, trash, internet, etc.) from the start date of occupancy.

6.2 Failure to Maintain Service. Tenants must maintain continuous utility service. Disconnection may be treated as abandonment.

6.3 Utility Interruptions. Temporary interruptions due to maintenance, utility providers, or emergencies are not grounds for rent abatement unless required by law.

    7. Pets & Animals

7.1 Approval Required. No pets are allowed without prior written approval from CARIV LLC.

7.2 Fees. Approved pets may require a pet deposit and/or monthly pet rent as specified in the lease.

7.3 Pet Responsibility. Tenants are responsible for all pet damage, waste cleanup, and compliance with local leash and vaccination laws.

7.4 Service/Support Animals. CARIV LLC fully complies with the Fair Housing Act and ADA regarding verified assistance animals.

    8. Insurance & Liability

8.1 Renter’s Insurance. Tenants are strongly encouraged (and may be required by lease) to maintain renter’s insurance covering at least $100,000 in liability and personal property protection.

8.2 Company Insurance. CARIV LLC’s insurance does not cover tenant belongings or liability for tenant negligence.

8.3 Indemnification. Tenants agree to indemnify and hold harmless CARIV LLC, its employees, and contractors from any claims or damages arising from the tenant’s use or occupancy, except where caused by gross negligence of CARIV LLC.

    9. Safety, Entry & Inspections

9.1 Smoke Detectors. Tenants must not disable or remove smoke or CO detectors and must replace batteries as needed.

9.2 Security. Tenants are responsible for securing the property. CARIV LLC is not liable for theft, vandalism, or injury unless caused by its negligence.

9.3 Periodic Inspections. CARIV LLC may perform scheduled property inspections with proper notice to ensure lease compliance.

    10. Default & Eviction

10.1 Default. Failure to pay rent, violation of lease terms, or illegal activity constitutes default.

10.2 Eviction Timeline. Eviction proceedings will commence after two (2) months of unpaid rent, unless earlier action is taken as permitted by Missouri law (RSMo §535.060–§535.110).

10.3 Mitigation. CARIV LLC will take reasonable steps to mitigate damages by attempting to re-rent the property if a tenant vacates early.

10.4 Legal Fees. Tenants are responsible for reasonable legal fees, court costs, and filing fees incurred due to nonpayment or breach of lease, as allowed by Missouri law.

    11. Termination & Move-Out

11.1 Notice to Vacate. Tenants must provide at least 30 days’ written notice prior to the end of the lease term or month-to-month period.

11.2 Move-Out Condition. The property must be left clean and in good condition, with all keys returned. Failure to do so may result in deductions from the security deposit.

11.3 Abandonment. Missouri law (RSMo §441.065) permits removal of personal property 10 days after posting written notice if the tenant has abandoned the premises.

    12. Disclaimers & Limitation of Liability

12.1 As-Is Basis. Except as required by law, the property is provided “as-is.” CARIV LLC disclaims all implied warranties beyond habitability required by law.

12.2 Limitation of Liability. To the fullest extent allowed, CARIV LLC shall not be liable for incidental, consequential, or punitive damages, including loss of property or business interruption.

    13. Governing Law & Dispute Resolution

13.1 Governing Law. These Terms and any disputes shall be governed by the laws of the State of Missouri.

13.2 Dispute Resolution. The parties will attempt to resolve disputes in good faith. If unresolved, disputes may proceed to binding arbitration or small claims court, except where Missouri landlord-tenant law mandates judicial eviction proceedings.

13.3 Venue. Any litigation shall be brought in the county where the property is located.

    14. Modifications & Notices

14.1 Changes to Terms. CARIV LLC may update these Terms at any time. Updates will be posted on the Website/Portal with a new “Last Updated” date.

14.2 Notice Delivery. Notices may be delivered in person, by mail, posted to the property, or electronically via email/portal when permitted by law.
